1. Acceptance of Terms.
By accessing or using The Vault or The Backend (collectively referred to as the "Services"), you ("User") unconditionally agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between the User and the Provider, Sir Dominic Scott, or any associated entities or successors-in-interest ("Provider"). Use of the Services signifies full acceptance of these Terms without exception or modification. If you do not agree to these Terms, you are prohibited from accessing or using the Services. The Provider reserves the right to enforce these Terms to the fullest extent permitted by law.
2. Limitation of Liability.
To the fullest extent permitted by applicable law, the Provider, including but not limited to The Vault, The Backend, Sir Dominic Scott, affiliates, agents, licensors, and assigns, disclaims any and all liability for claims, losses, or damages of any kind arising from or relating to the User's access to or use of the Services. This includes, but is not limited to, claims for personal injury, psychological harm, financial loss, incidental, consequential, punitive, or exemplary damages, or loss of data, revenue, or goodwill, whether arising from negligence, breach of contract, or any other legal theory. Users acknowledge and accept that participation in activities such as hypnosis or the use of "popper" content, or any other materials provided through the Services, is undertaken at their sole risk and discretion. The Provider shall not be liable for any adverse effects or consequences arising from such usage, and the User irrevocably waives all claims against the Provider in this regard.
3. Sales and Refund Policy.
All sales made to Sir Dominic Scott, or any entity associated with the Services, are deemed final, complete, and irrevocable upon receipt of payment. Refunds are issued solely at the absolute and exclusive discretion of the Provider and only under demonstrable circumstances involving material misrepresentation or functional defects in the product or service provided. Refunds for subjective dissatisfaction, buyer’s remorse, or failure to meet personal expectations are expressly excluded unless required by applicable consumer protection laws. Users agree that initiating chargebacks, reversals, or similar actions without first attempting resolution with the Provider constitutes a material breach of these Terms and may result in suspension of access, forfeiture of services, and legal action to recover damages, including costs and attorney’s fees.
4. Access and Communication.
Access to the Services does not, under any circumstances, confer the right to direct communication, engagement, or interaction with Sir Dominic Scott or any representatives of the Provider. All communication or interaction, if any, shall occur solely at the Provider’s discretion and shall not be construed as a right or entitlement of the User. The Provider reserves the right to terminate, suspend, or decline communication at any time without explanation, and Users waive all claims arising from such decisions.
5. Age Requirement and Legal Compliance.
By accessing or using the Services, the User represents and warrants that they have attained the legal age of majority as defined by their jurisdiction and possess the legal capacity to enter into these Terms. Users affirm that their use of the Services complies with all applicable local, state, national, and international laws, regulations, and treaties. The Provider disclaims any obligation to verify User compliance and assumes no liability for consequences arising from non-compliance. Any misrepresentation of age or legal eligibility constitutes a material breach of these Terms, subjecting the User to suspension of access and potential legal action.
6. Jurisdiction, Governing Law, and Dispute Resolution.
These Terms, and all matters relating to the use of the Services, are governed exclusively by the laws of the jurisdiction specified by the Provider, without regard to conflict-of-law principles. Users agree to submit to the exclusive jurisdiction of the courts within the Provider’s chosen jurisdiction and waive objections to venue or personal jurisdiction therein. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA) or a comparable body chosen by the Provider, with arbitration conducted in the Provider’s designated jurisdiction. Users waive their right to initiate or participate in class or collective actions. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7. Modifications to Terms.
The Provider reserves the unilateral right to modify, amend, or replace these Terms at any time, with such changes taking immediate effect upon posting or notification to Users, whichever occurs first. Users are responsible for reviewing the Terms for updates. Continued use of the Services following modifications constitutes acceptance of the revised Terms. The Provider assumes no liability for User failure to review updated Terms.
8. Intellectual Property and Content Usage Restrictions.
All content provided through the Services, including but not limited to text, images, videos, audio, and interactive materials, is the exclusive property of the Provider or its licensors and is protected under applicable intellectual property laws. Users are granted a limited, revocable, non-exclusive, and non-transferable license to download and use content solely for personal, non-commercial purposes. Unauthorized reproduction, redistribution, public display, or modification of such content is strictly prohibited and may result in termination of access, forfeiture of rights, and legal action, including claims for damages, injunctive relief, and recovery of attorney’s fees. Users agree to indemnify and hold harmless the Provider for any damages resulting from violations of this provision.
9. Acknowledgment and Enforcement.
By accessing or using the Services, Users acknowledge that they have read, understood, and agreed to abide by these Terms. Failure to comply with any provision may result in suspension of access, forfeiture of payments made, and legal action by the Provider to enforce compliance or recover damages. The Provider reserves the right to enforce these Terms to the fullest extent permitted by law, including seeking equitable remedies where appropriate.
